One number, one map: the age of legal purchase
The good news for buyers moving within the EU is that the legal purchase age for vaping products is nearly uniform: 18 years across almost every EU member state, set by national tobacco laws that extend the smoking age to e-cigarettes and, in most countries, to nicotine-free devices as well. The complications live in the details: which products the age limit covers, how strictly online sellers must verify age, and which neighbouring non-EU markets differ. This guide maps the landscape country by country and links to the mechanics of age verification in practice, which we cover for Germany in the dedicated online age verification guide. The same rules shape what happens face to face: our counter-refusal guide covers when a shop may decline a sale.
Why the age is 18 almost everywhere
The EU Tobacco Products Directive itself does not set a purchase age; age limits are national law. But nearly all member states anchored their vaping rules to existing tobacco purchase ages, which were already 18 in most of the bloc before e-cigarettes arrived. The result is de facto harmonisation:
| Country | Minimum age for vaping products | Notes |
|---|---|---|
| Germany | 18 | Covers nicotine and nicotine-free e-cigarettes; strict online identity checks |
| France | 18 | Applies to vaping products regardless of nicotine content |
| Italy | 18 | Online nicotine sales additionally restricted, see our Italy coverage |
| Spain | 18 | Disposable ban still in legislative process, not law, per our Spain guide |
| Netherlands | 18 | Remote sales of nicotine products banned, see the NL online sales guide |
| Belgium | 18 | Disposable ban in force since 2025, per our Belgium guide |
| Poland | 18 | Remote sales ban incl. nicotine-free, per our Poland guide |
| Austria | 18 | Monopoly structure and online sales ban, per our Austria guide |
| Czechia | 18 | Flavour tightening from late 2025, per our Czechia guide |
| Ireland | 18 | Disposable ban passed, effective 2027-01-24, per our Ireland guide |
| Sweden / Denmark / Finland | 18 | Flavour restrictions vary, per our Nordics guide |
| Hungary / Romania / Bulgaria | 18 | Per our eastern EU guide |
| United Kingdom (non-EU) | 18 | Disposable ban since 2025-06-01, per our bans overview |
| Norway / Switzerland (non-EU) | 18 | Covered in our Switzerland shipping guide |
The pattern is consistent enough that any claim of a lower vaping age inside the EU deserves suspicion. Where you may see "16" in older sources is Austria's pre-2019 regime for tobacco, superseded when Austria aligned smoking and vaping at 18.
Nicotine-free devices: the frequently missed detail
A recurring assumption is that 0 mg devices escape the age limit. In most of the EU they do not. Germany, the Netherlands, Poland and Austria all extend their age requirements to nicotine-free e-cigarettes, and several more member states regulate the device itself regardless of liquid content. The practical rule for a buyer: assume the age limit applies to the hardware, not just to the nicotine. Our zero-nicotine guide covers the product side of that market.
How age is checked in practice
Physical retail relies on staff, which makes enforcement uneven but visible. Online retail is where the rules bite hardest, and they differ by country:
- Germany requires documented age verification before the sale completes, typically an identity check service or the PostIdent-style handover at delivery, described step by step in our verification guide and at the delivery stage in delivery age checks.
- Markets with banned remote sales, including the Netherlands, Poland and Austria, sidestep the question by prohibiting the online channel entirely; the cross-border picture is summarised in our cross-border sales guide.
- Italy and Portugal restrict online nicotine sales as well, which our southern Europe guide covers in detail.
For the buyer, this means a legitimate EU online shop will always ask for age confirmation somewhere in the process, usually twice: once at checkout and once at handover. A shop that never verifies age is not a loophole, it is a red flag, the same one raised in our shipping scam guide.
Buying for someone underage: where the liability lands
Gifting a vaping product to a minor is a legal risk for the giver in most member states, not merely a rule for the shop. German law, for example, prohibits supplying tobacco and e-cigarette products to under-18s, with liability extending to the person who provides them, not only the retailer. Retail-side obligations are enforced with real fines; German penalties reach into five figures, a scale noted in our advertising compliance guide where enforcement overlaps.
Travel and the age question
Age limits follow you across borders in a practical sense: a product legal to buy at home can still be restricted where you use it, and customs rules treat quantities differently. Carry regulations, battery limits and packing rules are covered in our flying with vapes guide, and the tax side of moving products within the EU in our VAT and customs guide. The age floor itself rarely changes at the border inside the EU, but the product categories allowed do, and the regulatory direction of travel is tracked in our TPD III status guide.
Frequently asked questions
Is 18 the age everywhere in the EU?
Effectively yes for vaping products. No current EU member state sets a lower purchase age for e-cigarettes, and several, including Austria historically, moved upward to 18 in recent years. Always check the specific country guide if you need certainty for a trip or relocation.
Do shops have to see ID in person?
In-store, staff discretion plus mandatory training governs the check. Online, verification is increasingly procedural: identity services, verified-payment handover or ID-checked delivery, with Germany the strictest we ship to, as our German guide documents.
What about buying nicotine-free vapes for a 17-year-old?
Not advisable and in several countries, including Germany and Poland, explicitly unlawful because the age rule attaches to the device. The safe assumption is 18 for all vaping hardware.
Where can I read the rules per country in more depth?
Our country series covers the major markets: start with the EU country flavour guide and the German TPD guide, then the linked country pages above. Product-side background, including how strengths map to the 20 mg/ml ceiling, sits in our nicotine strength guide.
