TPD Rules for Vapes in Germany: The 2ml and 20mg Limits Explained

Why every disposable in Germany looks the same size

If you have ever wondered why the e-liquid tank inside a German-market disposable is always 2 ml, or why nicotine strength stops at 20 mg/ml, the answer is one EU directive. The Tobacco Products Directive — TPD 2014/40/EU, Article 20 — has governed every e-cigarette sold in the Union since 20 May 2016, and Germany enforces it strictly. It is also the reason products like big-puff devices have a slightly odd-looking two-part design, which we will explain below.

This guide covers exactly what the TPD restricts, what it deliberately leaves to national law, and how to check that what you are buying is compliant. Taxation is one of the areas left entirely to national governments - our EU vape tax comparison shows how far the three largest markets have diverged.

The four hard limits you will actually notice

1. Maximum 2 ml per tank or pod

The liquid reservoir of a disposable vape, pod or tank may hold no more than 2 ml of e-liquid. This is why a "12,000-puff" device sold in Germany is never one sealed tank: it is a TPD-compliant 2 ml pod paired with a separate refill container. The refill container itself is capped at 10 ml. Multi-pod systems such as 4-in-1 devices simply multiply compliant 2 ml pods.

2. Maximum 20 mg/ml nicotine

A separate German proposal would restrict thirteen additives, mostly cooling agents and menthol - see our Germany flavour rules guide for where that process actually stands. No e-liquid sold in the EU may exceed 20 mg/ml (2%). That is the ceiling for freebase nicotine, nicotine salts and every nicotine formulation — and it is enforced at customs and retail level. Our guide to nicotine strengths explains how 20 mg/ml compares with the strengths most smokers need in practice. Nicotine-free liquid is unrestricted in strength terms but still subject to tank-size and labelling rules.

3. Mandatory health warnings

Both major outer surfaces of the packaging must carry the warning "This product contains nicotine which is a highly addictive substance." The warning must cover 30% of the surface area, in a prescribed font size on a white or black background — the full packaging and labelling rules cover everything else the pack has to carry. If a listing photo shows packaging without the uniform warning block, treat the product as non-compliant — our counterfeit checklist covers this in detail.

4. Banned additives

E-liquids may not contain vitamins, colourings, caffeine, taurine or other additives that make the product appear to have a health benefit or energy effect. Flavourings must be safe for inhalation purposes, not just food-grade.

What the TPD does not regulate

The directive sets a floor, not the full picture. Several things you will encounter in Germany come from national law instead:

  • The e-liquid tax: Germany taxes all e-liquid — nicotine-free included — at €0.32 per millilitre as of 2026, which is part of why German prices sit above some EU neighbours. The full timeline is in our German vape tax guide.
  • Youth protection and age limits: the 18-plus rule, and the certified age-verification systems required for online sales, come from the JuSchG, not the TPD. Advertising is restricted at national level in the same way — our EU vape advertising rules guide covers what a shop may publish.
  • Where you may vape: public-use rules are federal and state law, covered in our guide to vaping in public in Germany.
  • Track-and-trace and security features: packaging must carry a tax stamp (Steuerzeichen) under German tobacco tax law.

Why compliant products get "notified" at all

Before a new e-liquid or device variant is placed on an EU market, the manufacturer must submit a technical notification to that member state: ingredients, toxicological data, emission test results and nicotine dosing information. Germany currently charges no notification fee, unlike some neighbours. For you as a buyer, this matters indirectly: a serious brand selling in Germany has already passed its formulations through this process, while grey-import products have not.

How to check compliance before you buy

  • Label check: 2 ml marked on the tank, nicotine strength in mg/ml and %, the 30% health warning, the manufacturer's EU address and a batch number.
  • Tax stamp: a German-market product carries the Steuerzeichen band on the packaging.
  • Realistic puff claims: a compliant 2 ml tank delivers roughly 600 puffs. "12,000 puffs" claims are only true for devices that include refill containers or multiple pods — a legitimate design, but you should be able to see the extra pods or refills in the listing.
  • Sensible pricing: prices dramatically below the norm usually mean non-compliant stock, and the fake-product signs tend to show up elsewhere too.

Frequently asked questions

Can I legally buy a 20 mg/ml vape online in Germany?

Yes, as long as the seller runs the required age verification and the product is TPD-compliant. The full online-ordering rules are in our guide to buying vapes legally online in Germany.

Why do devices sold outside the EU have more liquid?

Different jurisdictions, different rules. Non-EU versions with larger tanks are not legal to sell in Germany, and importing them for resale is not permitted. Personal carry limits when travelling are a customs matter — see our guide on cross-border rules for Austria and Switzerland.

Does the 2 ml rule apply to nicotine-free liquid?

The 2 ml tank cap applies to the hardware design; nicotine-free liquid in bottles is capped at 10 ml per bottle for refills under the same directive. Strength-wise, zero-nicotine devices follow the same hardware limits.

The short version: the TPD caps tanks at 2 ml and nicotine at 20 mg/ml, forces honest labelling and warnings, and Germany layers its own tax, age-verification and public-use rules on top. Every product listed in our disposable range is selected to meet both layers.
