Since 1 January 2026, every millilitre of e-liquid sold in Germany — nicotine or not — carries an excise duty of €0.32. That is the final step of the Tobacco Tax Modernisation Act (Tabaksteuermodernisierungsgesetz), and it has visibly changed prices on German shelves and in online shops. If you buy vapes in Germany or order them into Germany, here is exactly what the tax is, what it applies to, and how it affects what you pay.
The tax timeline: 2022 to 2026
Germany introduced its e-liquid duty in mid-2022 and scheduled increases every one to two years. For how that compares with Austria and France, see our EU vape tax comparison. The per-millilitre rates:
| Effective date | Rate per ml | Duty on a 10 ml bottle |
|---|---|---|
| 1 July 2022 | €0.16 | €1.60 |
| 1 January 2024 | €0.20 | €2.00 |
| 1 January 2025 | €0.26 | €2.60 |
| 1 January 2026 | €0.32 | €3.20 |
On top of the duty sits the normal 19% VAT — calculated on the price including the excise tax, so the tax is effectively taxed again. That compounding is why German retail prices have risen faster than the duty itself.
What the tax applies to
- Nicotine e-liquid — taxed at the full rate.
- Nicotine-free e-liquid — taxed at exactly the same rate. Germany deliberately taxes by volume, so "0mg" does not mean "tax-free".
- Bases, aromas, longfills and shortfills — all vaporisable liquids are covered, which closed the loophole other countries left open.
- Disposables and prefilled devices — the liquid inside is dutiable, which is part of why device prices have climbed.
The tax stamp (Steuerzeichen)
Legal products in Germany must carry a physical tax stamp issued through the Hauptzollamt Bielefeld. Selling untaxed nicotine products is a criminal offence, and customs (Zoll) actively checks shipments. For buyers, the stamp doubles as an authenticity signal — which is also why our guide to spotting fake vapes lists it among the checks worth doing.
What it means for prices in 2026
The duty explains most of the price gap between German retail and tax-free markets. A bottle that cost €6.99 in 2024 typically retails around €9.50 in 2026 — the duty rose €1.20 and VAT-on-duty added the rest. Large-format bottles are hit hardest: a 100 ml shortfill now carries over €32 in duty alone before VAT, which is why German shops have pivoted to high-concentration small volumes and prefilled devices.
For disposables, the arithmetic actually favours high-capacity devices: the duty is baked into a fixed liquid volume, so a Bang Box 80000 delivers far more puffs per euro of tax than a small 600-puff bar. That is one reason 20K–80K devices dominate German ordering lists — see our picks of the best disposable vapes in Germany for 2026.
Buying online: does the tax apply to you?
Products already sitting in a German warehouse are taxed before you order — the price you see at checkout is final, which is one of the underrated advantages of ordering from EU-warehouse stock. Cross-border shipments from outside the EU are a different story: customs can assess duty, VAT and handling fees on arrival, and untaxed goods can be seized. Our EU delivery times guide explains how in-country stock avoids all of that.
The bigger regulatory picture
The tax is one of three levers moving the German market in 2026. Second, the Bundesrat has pushed for a national disposable vape ban — still not in force, but tracked in our Germany legality guide. Third, retailers must now take back used devices for free under the ElektroG amendment — covered in our disposal guide. Expect Germany to remain one of Europe's most expensive vape markets, with annual increases widely expected to continue from 2027.
FAQ
Does the German vape tax apply to 0% nicotine vapes?
Yes. Germany taxes all vaporisable liquid by volume regardless of nicotine content — unlike most EU countries.
How much tax is in a disposable vape?
Depends on liquid volume. A device with 20 ml of liquid carries €6.40 of duty; a 2 ml TPD pod carries €0.64. VAT then applies on top.
Will the tax keep rising?
The scheduled steps end at €0.32 in 2026, but the law includes escalation logic and policymakers have signalled further increases from 2027. Budget for annual rises.
Is it cheaper to order from outside Germany?
Only until customs gets involved. Intra-EU orders from a taxed German warehouse avoid border fees entirely — for most buyers that is the cheaper, safer route.
Buying from Outside Germany: Where the Tax Bites
The German vape tax is charged at the point the product enters the domestic supply chain, not at the till. That single detail explains a question buyers ask constantly: why a bottle ordered from another EU country can arrive without a German tax stamp, and why that is not automatically a problem or automatically fine.
Two situations look similar and are not. If the seller holds stock inside Germany, the tax has already been paid and the stamp should be on the product. If the seller ships from a warehouse in another EU state, the tax is due in that country instead, and the German stamp will not be present. The confusion arises with marketplace sellers who ship domestically but source informally. Our guide to spotting fake disposable vapes covers how to check a stamp and a verification code, and how Germany compares with Austria and France shows what the same product costs on the other side of a border.
