Where Can You Vape in Germany? The 2026 Rules by State

Germany has no single national law saying where you can and cannot vape. The rules come from two layers: federal law covering transport, public buildings and youth protection, and sixteen state non-smoker protection laws (Nichtraucherschutzgesetze) that increasingly treat vaping exactly like smoking. Here is the practical map for 2026, so you do not get a €50–€250 fine for lighting up in the wrong place.

The federal layer

  • Trains and stations: Deutsche Bahn bans vaping on all its trains and platforms — ICE, IC, regional, S-Bahn. Federal-jurisdiction stations prohibit it too.
  • Local public transport: U-Bahn, trams and buses are no-vape across essentially every major city.
  • Federal buildings: banned in government buildings, parliament and ministries.
  • Schools and youth facilities: strictly banned wherever minors are present, under the Youth Protection Act.
  • Age: 18 to buy or vape, including zero-nicotine products — see the Germany legality guide for the full framework.

The state layer: where it gets specific

Each Bundesland writes its own indoor rules, and the trend is uniform: e-cigarettes are folded into smoking bans. In practice:

  • Bavaria, North Rhine-Westphalia, Baden-Württemberg: the strictest regimes — vaping is treated as smoking in restaurants, bars, clubs, public buildings and stations.
  • Berlin, Hamburg: partial bans. Government buildings and public transport are covered; outdoor hospitality areas are generally more permissive.
  • Saxony, Thuringia and other eastern states: legislation extending existing smoking bans to vaping has been drafted, with votes expected through 2026.
  • Beer gardens: traditionally treated like smoking areas, so usually permissible — but venue policy can be stricter than state law.

The safe mental model: if smoking is banned there, assume vaping is too, unless the venue explicitly says otherwise. The evidence behind those rules is more nuanced than the rules themselves, and our breakdown of second-hand vapour research sets out what the studies measured.

Outdoors, cars and your own space

Outdoor public areas are generally fine, with local exceptions near schools, hospitals, playgrounds and some station entrances. In your own car, the rules are yours to set — but vaping while driving is banned in some other countries and can attract distraction penalties; treat freight-type caution as sensible. In your home and on your balcony, the landlord and building rules matter more than state law.

Workplaces and hospitality

Whether you can vape at work is up to the employer in most cases, and most German employers ban indoor vaping as a matter of policy rather than law. If your workplace has a designated smoking area, it is usually the correct place to vape — but ask, because some employers prohibit e-cigarettes there too. The legal basis for that, and the limits on what an employer can set, is in vaping at work in Germany.

Hotels

Almost universally banned in rooms. German and international chains routinely charge cleaning fees of €100–€250 for a breach, and detection is easy because vapour residue sets off the same sensors as smoke. If you want to vape, book a room with a balcony or ask at check-in what the policy actually is.

What is coming

Two changes are worth tracking. First, states that have not yet extended their smoking bans to vaping are actively drafting the changes, so the number of permissible indoor locations is shrinking. Second, a national ban on disposable vape sales has been repeatedly advocated by the Bundesrat and remains under review — sales are still legal, and the current status is covered in our legality guide. If a ban is implemented, rechargeable formats such as pod systems become the practical fallback, which is exactly why that comparison matters for planning.

Where the rules do not stop you

Buying is another matter entirely: ordering devices for delivery to an address in Germany is straightforward, and the full disposable range ships from our Berlin warehouse with age-verified delivery. Taxes on the liquid inside are already paid on in-warehouse stock — background in the Germany vape tax guide — and used devices go back to any shop that sells them under the 2026 take-back rules.

FAQ

Can I vape at my table in a German restaurant?

Only where the state permits smoking and the venue allows it. In Bavaria, NRW and Baden-Württemberg: no. In Berlin and Hamburg: depends on the venue and area.

Is vaping on a train platform allowed?

No on DB platforms and in federal-jurisdiction stations; fines can reach several thousand euros for serious breaches on rail property.

Is vaping in a car with children in it illegal?

Germany has restricted smoking in cars carrying minors; vaping is caught by the same logic in several states. Do not do it.

Does any German state still allow vaping indoors everywhere?

No state gives blanket indoor permission. The variation is in how strictly hospitality venues are covered, and that variation keeps narrowing.

Rules inside a vehicle follow the same logic as the indoor rules by state, and the specific case of driving — including what changed in 2025 — is covered in our guide to vaping in a car.

Smell and legality are related but separate questions — what the scent does and does not leave behind is covered in our does-vaping-smell guide.
