Returns and Warranty for Vape Orders in Germany Explained

Your rights when a vape order goes wrong

Vape products sit at an awkward intersection of consumer law: they are ordinary online purchases with a 14-day right of withdrawal, but they also touch your mouth, which brings hygiene exceptions into play. Knowing which rule applies to which situation saves you from a rejected claim — and from retailers who use "hygiene" as a blanket excuse for refusing everything.

Here is how the rules actually work for orders delivered in Germany, and how to make a claim that gets approved.

Rule 1: the 14-day right of withdrawal (unopened goods)

Under the EU Consumer Rights Directive (2011/83/EU), you may cancel an online order within 14 days of receiving it, for any reason or none at all — buyer's remorse included. This applies to vape products like any other distance purchase.

  • The clock starts the day you receive the parcel, not the day you order.
  • You do not need a justification.
  • Return shipping is normally at your cost for change-of-mind returns; from the seller for errors and defects.
  • You must send the goods back within 14 days of declaring the withdrawal.

The condition that matters: the item must be unopened and in its original sealed packaging. Break the seal and the right changes character, which brings us to the exception.

Rule 2: the hygiene exception (opened goods)

Article 16(e) of the same directive lets retailers exclude goods that are sealed for health or hygiene reasons once the seal is broken. Every serious vape retailer applies this to e-liquid, prefilled pods, mouthpieces and disposables. Once opened, a device is no longer resellable and cannot be returned for a change of mind.

Worth understanding: this is a narrow exception, not a general waiver. It does not remove your rights when the product is faulty — it only affects voluntary, no-reason returns. A wrong item in the box is a different, stronger case — see our wrong item guide. A trader who refuses a genuinely defective device by citing hygiene is misapplying the rule, and our checklist below covers how to push back.

Rule 3: defects and the two-year statutory guarantee

Separately from withdrawal rights, every consumer purchase in the EU comes with a statutory guarantee: for two years from delivery, the seller must remedy a product that was not as described or not of satisfactory quality. For vapes, that means a device that fails prematurely through no fault of yours.

In practice, retailers distinguish two situations:

SituationTypical handling
Dead on arrival (DOA) — does not work out of the boxReplacement or refund, without debate. Report within 48 hours of delivery; most shops accept DOA claims up to 30 days.
Fails mid-life, having worked correctly for a whileAssessed case by case. If the device delivered most of its advertised puff count before failing, that is normal end of life rather than a defect.
Defective and within a short window (first days)Consumer-friendly resolution expected: replace or refund at no cost to you.
Physical damage, modifications, liquid misuseNot covered. Cracked casings, opened devices and DIY modifications void claims.

Note the difference between the two clocks: withdrawal is 14 days with no reason needed; the guarantee is up to two years, but you must show the fault. If you want to know what a failing device actually looks like, we cover the symptoms in the not-charging guide and the burnt-taste guide — both distinguish real faults from normal wear.

How to file a claim that gets approved

  1. Check the parcel before opening. If the box is crushed or punctured, photograph it before touching the contents. This distinguishes shipping damage from a manufacturing defect, which changes who pays.
  2. Keep the original packaging. It protects the item and proves it was not manhandled.
  3. Record the first puff. A short unboxing video is disproportionately persuasive for DOA claims and proves the device arrived sealed.
  4. Report quickly. Most shops require notification within 48 hours for shipping damage and DOA; waiting a week weakens the claim.
  5. Contact support before shipping anything back. Ask for a return authorisation or label. Unannounced returns regularly get refused.
  6. State the facts plainly. Order number, what failed and when, photos, and what you are asking for. Do not claim a defect for a device that simply ran its course — that wastes everyone's time and undermines genuine claims.

Business-to-business orders are different

The withdrawal right and statutory guarantee above are consumer protections. Wholesale orders are governed by the contract, not by consumer law — return windows, minimum quantities and defect notification periods are negotiable and usually shorter. See our wholesale guide for the B2B side.

Frequently asked questions

Can I return a device because I do not like the flavour?

If it is unopened and sealed, yes — the 14-day withdrawal right covers taste. If you have used it, no; that is the hygiene exception.

The shop says it does not accept returns. Is that legal?

Not for consumer purchases within the 14-day window — the withdrawal right is statutory in the EU and a shop's internal policy cannot remove it, although the packaging must be unopened. For defects, the two-year guarantee applies regardless.

What if my parcel is lost?

Responsibility sits with the seller until delivery; report the non-arrival and let the shop pursue the carrier. Standard practice for German retailers, and it is why our shipping guide recommends verified, tracked sellers.

Does this apply to orders to Austria or Switzerland?

The withdrawal right applies to EU consumer purchases including Austria. Swiss orders are outside the EU consumer-law framework, so terms depend entirely on the shop — our Austria and Switzerland guide covers the customs side of that.

Short version: unopened means 14 days, sealed-for-hygiene applies only to change-of-mind returns, and genuine defects are protected for up to two years regardless of what a policy page claims.
